These Terms of Service (the Terms
) set forth the terms and conditions for the use of the BDE Service (the Service
) provided by Yoshiki Miura (the Company
).
Article 1 (Application)
- These Terms shall apply to all relationships between users and the Company regarding the use of the Service.
- In addition to these Terms, the Company may establish various rules and regulations regarding the use of the Service (the
Individual Provisions
). These Individual Provisions, regardless of their name, shall constitute part of these Terms.
Article 2 (User Registration)
- The Service allows basic browsing functions to be used without registration.
- Those who wish to register as members must agree to these Terms and the Privacy Policy and apply for user registration by the method specified by the Company.
- The Service is intended for users aged 13 and above, and users under 13 years of age may not use the Service.
- The Company may refuse to approve applications for user registration if the Company determines that the applicant falls under any of the following circumstances, and the Company shall have no obligation to disclose the reasons for such refusal:
- When false information is provided in the application for user registration
- When the application is from a person who has previously violated these Terms
- When the application is from a minor, adult ward, person under curatorship, or person under assistance, without obtaining consent from their legal representative, guardian, curator, or assistant
- When the Company otherwise determines that user registration is inappropriate
Article 3 (Service Content)
- The Service primarily provides paid information about recommended stores and spots in Japan for foreign tourists visiting Japan.
- The Company may provide personalized information based on users' browsing history and search history.
- The specific functions and content provided by the Service may be changed at the Company's discretion.
Article 4 (Usage Fees and Payment Methods)
- Users shall pay the usage fees for paid functions of the Service as separately determined by the Company and displayed on this site, by the method specified by the Company.
- If payment of usage fees is delayed, the Company may suspend the use of the Service.
- Paid usage fees shall not be refunded in principle, except in cases attributable to the Company.
Article 5 (Prohibited Acts)
Users shall not engage in any of the following acts when using the Service:
- Acts that violate laws or public order and morals
- Acts related to criminal activities
- Acts that destroy or interfere with the functions of servers or networks of the Company, other users of the Service, or third parties
- Acts that may interfere with the operation of the Company's services
- Acts of collecting or accumulating personal information about other users
- Acts of unauthorized access or attempts thereof
- Acts of impersonating other users
- Acts of providing benefits directly or indirectly to antisocial forces in connection with the Company's services
- Acts for business, promotional, advertising, solicitation, or other commercial purposes (except those approved by the Company)
- Other acts that the Company deems inappropriate
Article 6 (Suspension of Service Provision)
- The Company may suspend or interrupt the provision of all or part of the Service without prior notice to users if the Company determines that any of the following circumstances exist:
- When conducting maintenance, inspection, or updates of computer systems related to the Service
- When provision of the Service becomes difficult due to force majeure such as earthquakes, lightning, fires, power outages, or natural disasters
- When computers or communication lines stop due to accidents
- When the Company otherwise determines that provision of the Service is difficult
- The Company shall not be liable for any disadvantage or damage suffered by users or third parties due to suspension or interruption of the Service provision.
Article 7 (Copyright)
- Users may only post or edit information for which they own the necessary intellectual property rights such as copyrights, or for which they have obtained permission from the necessary rights holders.
- Copyrights to information on the Service belong to the Company or legitimate rights holders, and users may not reproduce, reprint, distribute, sell, etc., without permission.
Article 8 (Usage Restrictions and Registration Deletion)
- The Company may restrict users' use of all or part of the Service or delete their user registration without prior notice if users fall under any of the following circumstances:
- When violating any provision of these Terms
- When false information in registration details is discovered
- When there is non-performance of payment obligations for usage fees, etc.
- When there is no response to communications from the Company for a certain period
- When the Service has not been used for a certain period since the last use
- When the Company otherwise determines that use of the Service is inappropriate
- The Company shall not be liable for any damage caused to users by actions taken by the Company under this Article.
Article 9 (Withdrawal)
Users may withdraw from the Service through withdrawal procedures specified by the Company.
Article 10 (Disclaimer and Limitation of Liability)
- The Company makes no warranty, express or implied, that the Service is free from defects in fact or law (including defects, errors, bugs, rights infringement, etc., related to safety, reliability, accuracy, completeness, effectiveness, fitness for particular purposes, security, etc.).
- The Company makes no warranty regarding the accuracy, currentness, usefulness, etc., of store information, business hours, prices, and all other information provided by the Service. This information is provided for reference purposes, and users must verify it themselves when actually using it.
- The Company assumes no responsibility for allergic reactions, food poisoning, or other health hazards caused by dining at restaurants introduced by the Service. Users with allergies or specific dietary restrictions must directly confirm with stores before use.
- The Company assumes no responsibility for services provided by third parties such as stores introduced by the Service. Disputes arising between users and third parties shall be resolved between the parties concerned.
- The Company assumes no responsibility for any damage caused to users arising from the Service. However, this disclaimer shall not apply if the contract between the Company and users regarding the Service (including these Terms) constitutes a consumer contract as defined in the Consumer Contract Act.
- Even in cases specified in the proviso of the preceding paragraph, the Company assumes no responsibility for special damages arising from special circumstances (including cases where the Company or users foresaw or could have foreseen the occurrence of damage) caused to users by the Company's negligence (excluding gross negligence) in breach of contract or tort. Furthermore, compensation for damage caused to users by the Company's negligence (excluding gross negligence) in breach of contract or tort shall be limited to the amount of usage fees received from users in the month when such damage occurred.
Article 11 (Changes to Service Content)
The Company may change, add, or discontinue the content of the Service with prior notice to users, and users agree to such changes.
Article 12 (Changes to Terms of Service)
- The Company may change these Terms without individual consent from users in the following cases:
- When changes to these Terms conform to the general interests of users
- When changes to these Terms do not contradict the purpose of the Service usage contract and are reasonable in light of the necessity of changes, the appropriateness of post-change content, and other circumstances related to the changes
- When making changes to these Terms under the preceding paragraph, the Company shall notify users in advance of the fact that these Terms will be changed, the content of the Terms after changes, and the effective date of such changes.
Article 13 (Handling of Personal Information)
The Company shall appropriately handle personal information acquired through use of the Service in accordance with the Company's Privacy Policy.
Article 14 (Notices and Communications)
Notices and communications between users and the Company shall be made by methods specified by the Company. The Company shall consider currently registered contact information as valid and send notices or communications to such contact information unless users provide change notifications according to methods separately specified by the Company, and such notices or communications shall be deemed to have reached users at the time of transmission.
Article 15 (Prohibition of Transfer of Rights and Obligations)
Users may not transfer to third parties or pledge as security their position under the usage contract or rights or obligations under these Terms without prior written consent from the Company.
Article 16 (Governing Law and Jurisdiction)
- These Terms shall be governed by Japanese law.
- In case of disputes regarding the Service, the court having jurisdiction over the Company's location shall have exclusive agreed jurisdiction.
